Frankel Syverson PLLC Appointed Class Counsel in WARN Act Mass Layoff Lawsuit


On May 19, 2023, the lawyers at Frankel Syverson PLLC filed a class action on behalf of employees at MedAvail, alleging that the company failed to comply with the requirements of the Worker Adjustment and Retraining Notification Act (“WARN Act”) when it laid off over a hundred employees around January 2023. 

The WARN Act requires most employers with one hundred or more full time employees to give at least 60 days advance notice to an employee who will lose their job when there is a mass layoff that involves a large number of employees. 

The notice required under the WARN Act is intended to give employees 60 days to prepare for the loss of their job. If an employer does not provide the required notice before the employee is laid off, the WARN Act requires the employer to pay each affected employee up to 60 days’ worth of wages and job benefits.

The former employees of MedAvail allege that the company failed to provide them with 60 days advance notice of a mass layoff, and as a result, they should be entitled to 60 days’ worth of wages and job benefits for violation of the WARN Act. 

The Court certified the case as a class action on November 28, 2023, appointing the lawyers at Frankel Syverson PLLC as counsel for the class members.  This means that the named plaintiffs can pursue WARN Act violations on behalf of all the employees affiliated with the Phoenix, Arizona MedAvail site who were terminated without cause around January 18, 2023 and did not receive 60 days’ advance notice of the layoff.
